Terms and Conditions

Welcome to Sendit. These Terms and Conditions (“Terms”) govern your use of the Sendit platform, including the Sendit consumer app, Sendit Rider app, and Sendit Vendor app (together, the “Services”). By accessing or using any Sendit service, you agree to be bound by these Terms. If you do not agree, do not use our Services.
Your use of the Services is also governed by Sendit’s Privacy Policy, which describes how we collect, use, and protect your information. The Privacy Policy is available on our website and in the app. Please read it alongside these Terms.
1. General Terms (All Users)
- You must be at least 18 years old (or the age of majority in your jurisdiction) to use our Services.
- You must provide accurate, current, and complete information when registering or using the Services.
- You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
- Sendit reserves the right to suspend or terminate your access to the Services for breach of these Terms, fraud, or any conduct that we deem harmful to the platform or other users.
- We may update these Terms from time to time. Continued use of the Services after changes constitutes acceptance of the revised Terms. We will notify you of material changes via the app or email where appropriate.
- Our Services are offered from Ghana. Use from other jurisdictions is at your own risk and you are responsible for compliance with local laws.
2. Sendit Consumer App (Customers)
The Sendit consumer app allows you to order food from restaurants, send and receive parcels, shop from partner stores, and book event tickets. The following terms apply when you use the consumer app.
2.1 Orders and Payments
- You agree to pay all fees, delivery charges, and taxes associated with your orders as displayed at checkout.
- Payment methods (e.g. mobile money, card, cash on delivery where available) are subject to our and our partners’ policies.
- Refunds and cancellations are handled in accordance with our refund policy and, where applicable, the specific vendor’s or event organizer’s policy.
2.2 Deliveries
- Delivery times are estimates. Sendit and its riders are not liable for delays due to traffic, weather, or other circumstances beyond reasonable control.
- You are responsible for providing a correct and accessible delivery address and for being available to receive deliveries where required.
2.3 Events and Tickets
- Event tickets purchased through Sendit are subject to the event organizer’s terms and any venue policies.
- Event dates, times, and venues are determined by organizers; Sendit is not responsible for changes or cancellations by the organizer.
2.4 Parcels, Loss and Damage
When you send a parcel through Sendit:
- You are responsible for proper packaging and for providing an accurate description of the contents. Improper packaging or undisclosed or prohibited contents may result in loss, damage, or refusal of the delivery.
- Sendit is not liable for loss or damage caused by improper packaging, inaccurate or incomplete item descriptions, circumstances beyond our reasonable control (e.g. severe weather, road closures, force majeure), or the acts or omissions of third parties.
- Where applicable law permits, our liability for loss or damage to parcels may be limited to a reasonable amount as set out in our policies or as communicated in the app. We will handle claims in good faith in accordance with our internal procedures.
3. Sendit Rider App (Couriers)
The Sendit Rider app allows approved couriers to accept delivery assignments, navigate to pickup and drop-off locations, and earn fees. The following terms apply when you use the rider app.
3.1 Eligibility and Approval
- You must complete registration, provide required documents (e.g. ID, vehicle details), and be approved by Sendit before you can accept deliveries.
- Sendit may require background checks or other verification and may revoke access if you no longer meet our standards.
3.2 Conduct and Performance
- You must comply with all applicable traffic and safety laws and treat customers, vendors, and packages with care.
- You are responsible for your vehicle, insurance, and any costs of operating as a rider unless otherwise agreed in writing.
- Accepting a delivery constitutes your agreement to complete it in accordance with Sendit’s and the customer’s instructions, subject to our cancellation and reassignment policies.
3.3 Earnings and Payments
- Fees and payment schedules are as communicated in the rider app and may vary by delivery type, distance, and other factors.
- You must comply with any shift or fee payment requirements (e.g. shift fees) before you can complete certain actions in the app.
- Sendit may withhold or adjust payments in cases of fraud, breach of Terms, or disputed deliveries, in accordance with our internal policies.
3.4 Independent Contractor
Riders using the Sendit Rider app are independent contractors, not employees, agents, or representatives of Sendit. As an independent contractor, you:
- Are responsible for your own taxes, including any income tax and other obligations under Ghanaian law or the law of your place of residence.
- Are responsible for your own insurance (e.g. vehicle, health) and for ensuring your equipment and vehicle meet applicable legal and safety requirements.
- Are responsible for complying with all applicable laws relating to your delivery activities, including traffic and transport regulations.
- Do not have the authority to bind Sendit or to make commitments on Sendit’s behalf. Sendit does not control your hours, methods, or routes beyond what is necessary to provide the platform and meet customer and vendor expectations.
4. Sendit Vendor App (Restaurants & Event Organizers)
The Sendit Vendor app allows restaurant owners and event organizers to manage orders, menus, events, tickets, and payouts. The following terms apply when you use the vendor app.
4.1 Restaurant Partners
- You are responsible for the accuracy of menus, prices, availability, and food safety and hygiene standards.
- You must accept, prepare, and fulfill orders in accordance with Sendit’s and the customer’s instructions, and use the app to update order status accurately.
- Commission, fees, and payout terms are as set out in your partnership agreement and in the vendor app.
4.2 Event Organizers
- You are responsible for the accuracy of event details, ticket types, prices, and capacity, and for honoring tickets validated through Sendit.
- You must comply with applicable laws for events and ticket sales and with any venue or third-party agreements.
- Payouts for ticket sales are subject to our event payout policy and any agreed schedule.
4.3 General Vendor Obligations
- You must not list prohibited items or events or use the platform for illegal or misleading purposes.
- Sendit may suspend or terminate your vendor account for breach of these Terms or for conduct that harms the platform or users.
5. Prohibited Items and Activities
To keep the platform safe and legal, the following are not allowed on Sendit:
- Delivery: You must not send, deliver, or request delivery of illegal items; weapons, ammunition, or explosives; controlled or illegal drugs or substances; counterfeit or pirated goods; hazardous or dangerous goods; or other items restricted by law or by Sendit’s policies.
- Vendor listings and events: Vendors must not list, sell, or promote the above items. Events must be real and accurately described. Fraudulent, misleading, or fake events (e.g. scams or non-existent events) are prohibited.
- Sendit may suspend or terminate the accounts of users (customers, riders, or vendors) who breach these rules, and we may report serious violations to the relevant authorities where appropriate.
6. Payments, Chargebacks and Fraud
We take payment integrity seriously. The following applies across the platform:
- Chargebacks and payment disputes: If a customer or cardholder disputes a charge (e.g. chargeback, refund request), we will investigate in line with our policies and any applicable payment-provider rules. Vendors and riders may be required to provide information or evidence to resolve the dispute. Reversed or disputed amounts may be deducted from payouts or future earnings where appropriate.
- Suspected fraud: If we suspect fraud, money laundering, or other misuse of the Services, we may temporarily withhold payouts, suspend accounts, or restrict access while we investigate. We will act in good faith and, where possible, communicate with you in accordance with our policies and the law.
- Repeated chargebacks, fraudulent activity, or breach of these Terms may result in permanent suspension and, where required, reporting to authorities.
7. Intellectual Property
All Sendit apps, software, websites, trademarks, logos, and branding are owned by Sendit or our licensors. You may not:
- Copy, modify, or redistribute our software, design, or content without our written permission.
- Use our names, logos, or trademarks in a way that suggests endorsement or affiliation unless we have agreed in writing.
- Reverse-engineer or attempt to extract the source code of our apps or systems, except where expressly permitted by law.
You retain ownership of content you upload (e.g. menu photos, event details). By uploading it, you grant Sendit the rights we need to operate the Services (e.g. to display, store, and share it with relevant users and partners).
8. Disclaimers and Limitation of Liability
To the fullest extent permitted by law, Sendit provides the Services “as is” and disclaims all warranties, express or implied. We do not guarantee uninterrupted or error-free operation. In no event shall Sendit (or its affiliates, officers, or employees) be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Services or any transaction conducted through the platform, except where such limitation is prohibited by law.
9. Force Majeure
Sendit is not liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control. These may include, but are not limited to: natural disasters, severe weather, pandemics, war or civil unrest, government actions or orders, strikes or labour disputes, power or network failures, failures of third-party services (e.g. telecommunications, payment providers), or other events that could not reasonably have been foreseen or avoided. Where such events affect the Services, we will endeavour to resume normal operation as soon as practicable and to communicate with users where appropriate.
10. Governing Law and Contact
These Terms are governed by the laws of Ghana. Any dispute arising in connection with these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of Ghana, unless otherwise required by law.
